While people often associate the term "dissolution" with a more amicable way of divorcing, a dissolution generally occurs when the parties agree to all the terms to end the marriage prior to the filing of an action to terminate the marriage. 

​

While a lack of cooperation from your spouse can prevent a dissolution, the other party refusing to participate in the process does not serve to prevent you from getting a divorce.

What Is a Dissolution of Marriage?

 

A dissolution of marriage takes place when both parties agree to end the marital relationship by filing a petition for the dissolution and attaching a separation agreement.  All the conditions of the separation agreement must be agreed upon by both parties in order for the dissolution to take place.

After the petition is filed, a hearing to approve the separation typically takes place within 60 days later. 

 

Both parties must be present and must agree to the dissolution of their marriage under oath.  If one party does not agree or is not happy with the separation agreement, the dissolution cannot take place.  In many cases, if the agreement falls apart, then the matter is converted to a divorce action.

What Is a Separation Agreement in Ohio?

​

A separation agreement is a legally binding document that outlines and determines everything related to a couple’s separation that has been agreed upon.

​

A separation agreement outlines plans for the following, and more:

  • Division of property

  • Allocation of debt

  • Issues related to children, including parenting time and custody

​

For this agreement to be approved by a judge, both parties must consent to all the details outlined in the document and agree to follow the terms.

Divorce

Divorce is the contested process by which parties terminate their marriage.  Parties vary in their reasons for divorce, but it only takes one party asking for a divorce to get divorced.  Regardless of your reason, we can assist you in the process.

Establishing Parental Rights

Unfortunately, Ohio's fathers have no rights to their children, if they were not married to the mother at the time of the child's birth. 

 

These fathers must file a Petition for Allocation of Parental Rights to formally establish their right to parenting time, school records access, and medical records access.

Dissolution

The dissolution is a more amicable process whereby parties terminate their marriage.  It is more amicable, because the parties come to the court with an agreement as to the division of their assets and allocation of parental rights.

Custody & Abuse, Neglect, and Dependency cases

Parents may disagree as to what is in the best interest of their minor children; however, Ohio law provides guidance for the resolution of those conflicts by allocating custody to one parent.  The battle for custody should never be taken lightly, and should always rely upon an experienced attorney.

Shared Parenting

Shared parenting is the alternative to Custody.  It's designed for parties who communicate well and agree to share in the decision making responsibilities when it comes to their minor children.
